1. Acceptance of Terms

Omnismen ("we," "us," "our," omnismen.in) is a Shopify-powered store and content platform, presenting research into the lives of men worth learning from through curated content and products, and operated for customers located in India.

These Terms and Conditions ("Terms"), together with our Privacy Policy and any other policies referenced herein, govern your access to and use of omnismen.in and all related content, features, and services (the "Services"). By visiting, interacting with, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

We may update these Terms from time to time; see Section 20 for details.

2. Eligibility & Use of Services

By using the Services, you represent that you are at least 18 years of age and are located in India. If you provide us with information on behalf of a minor dependent, you confirm you have the authority and consent to do so.

To browse, purchase, or interact with certain features of the Services, you may be asked to provide information such as your name, email address, billing details, shipping address, and payment information. You represent that all information you provide is accurate, current, and complete, and that you have the right to provide it.

You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. You may not transfer, sell, or license your account to any other person.

3. Our Products & Sourcing Models

Omnismen offers products through several sourcing models, which may include:

Own Products — designed and fulfilled directly by Omnismen.
Dropship Products — fulfilled on our behalf by a third-party supplier or manufacturer.
Affiliate Products — linked from our content; purchases are completed on a partner's website under their own terms.
Brand Collaboration Products — co-branded or co-produced with a partner brand.
Bespoke / Made-to-Order Products — custom items produced to your specifications.

We make every effort to accurately represent our products, but colors, materials, and appearance may vary from what is shown on your screen due to your device and display settings. We do not warrant that products will meet your expectations or match their online depiction exactly. Product descriptions, pricing, and availability are subject to change at any time and without notice, and we may discontinue or limit the availability of any product at our discretion.

4. Orders & Acceptance

Placing an order through the Services constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity. An order is not accepted until we confirm it; we must receive and process payment before an order is accepted.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we are unable to fulfil, must change, or must cancel an order, we will attempt to notify you using the contact details provided at checkout.

You represent that your purchases are for your own personal or household use, and not for commercial resale or export, unless otherwise agreed with us in writing.

5. Pricing & Payment

All prices are listed in Indian Rupees (INR) unless otherwise stated, and are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as reflected in your order confirmation. Posted prices do not include applicable taxes, shipping, or handling charges unless expressly stated.

Payments are processed securely through Shopify's checkout and/or our third-party payment processors. You represent that any payment information you provide is accurate and that you are authorized to use the payment method provided. 6. Shipping & Delivery

We currently ship within India only. Delivery timelines provided at checkout or in order confirmations are estimates only and are not guaranteed. We are not responsible for delays caused by our shipping or delivery partners, or by circumstances outside our reasonable control. Once a product is handed over to our delivery partner, risk of loss passes to you, though we remain committed to helping resolve any delivery issues in accordance with our Returns & Refunds Policy.

7. Returns & Refunds

Returns, exchanges, and refunds are governed by our separate Returns & Refunds Policy, available at [Insert Link]. Please note that bespoke or made-to-order products may not be eligible for return or exchange except where defective, given their custom nature — full details are set out in that policy.

8. Content & Intellectual Property

All content on the Services — including text, graphics, video, photography, style guides, product descriptions, and the Omnismen name, logo, and brand assets — is owned by Omnismen or its licensors and is protected under Indian and international copyright, trademark, and other intellectual property laws.

You may view, download, and print content from the Services for your own personal, non-commercial use only. You may not reproduce, distribute, modify, publicly display, republish, or create derivative works from any content on the Services without our prior written consent. Unauthorized use may result in civil and/or criminal liability under applicable law.

Shopify's name, logo, and related marks are trademarks of Shopify and are used with permission as our e-commerce platform provider.

9. User Content & Feedback

If you submit comments, reviews, messages, or other content to us ("User Content" or "Feedback"), you represent that you have the right to share it and that it does not violate any law or third-party right. You grant Omnismen a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such User Content or Feedback in connection with operating and promoting the Services.

We do not endorse and are not responsible for opinions or statements expressed in User Content submitted by others. We reserve the right, but are not obligated, to review, edit, or remove any User Content at our discretion, including content that we consider inappropriate, unlawful, or in violation of these Terms.

10. Third-Party Links & Affiliate Disclosure

Our content and product listings may include links to third-party websites, including affiliate partners, suppliers, and social media platforms. We do not control and are not responsible for the content, accuracy, or practices of these third-party sites. If you click an affiliate link and complete a purchase, we may earn a commission at no extra cost to you; that purchase and any related terms are governed entirely by the third-party site's own policies, not these Terms.

11. Optional Tools & Automated Agents

The Services may provide access to tools or features operated by third parties, which we do not control and provide on an "as is" basis without warranty. Your use of any such optional tools is at your own risk.

If you use, enable, or deploy any automated software or "agent" (including AI-driven tools) to access or interact with the Services on your behalf, that agent must clearly identify itself as automated in its requests, must not attempt to disguise itself as a human user or bypass security measures such as CAPTCHAs, and must comply with any instructions we give to restrict or limit automated access. We reserve the right to block or restrict access by any agent that does not meet these requirements.

12. Prohibited Uses

You agree not to use the Services to: (a) violate any applicable law or regulation; (b) infringe our intellectual property rights or those of any third party; (c) transmit unsolicited advertising, spam, or malicious code; (d) harass, threaten, or harm any person; (e) impersonate any person or entity or misrepresent your affiliation with Omnismen; (f) collect or harvest personal information about other users without consent; or (g) use bots, scrapers, or other automated means to extract data from the Services except as permitted under Section 11.

We reserve the right to suspend or terminate access to the Services for anyone who violates these Terms.

13. Privacy

Because our Services are hosted on Shopify, certain information is also processed by Shopify in accordance with its own privacy policy.

14. Disclaimer of Warranties

The Services and all products offered through them are provided on an "as is" and "as available" basis. To the maximum extent permitted under applicable Indian law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or entirely secure, though we take reasonable steps to maintain their reliability and safety.

Nothing in this section limits any right or remedy you may have under the Consumer Protection Act, 2019, or other applicable Indian consumer protection law.

15. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Omnismen, its officers, employees, and service providers (including Shopify) shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or any product purchased through them. Our total liability for any claim relating to these Terms or the Services shall not exceed the amount you paid for the relevant order giving rise to the claim.

This limitation does not affect any liability that cannot be excluded or limited under applicable Indian law, including in cases of gross negligence or willful misconduct.

16. Indemnification

You agree to indemnify and hold harmless Omnismen, its officers, employees, and service providers from any claims, damages, liabilities, and reasonable legal costs arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

17. Termination

We may suspend or terminate your access to the Services at our discretion, without notice, if we believe you have violated these Terms. You remain responsible for any amounts due up to the date of termination. Provisions that by their nature should survive termination — including Sections 8, 9, 14, 15, 16, and 18 — will continue to apply.

18. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts having competent authority in India, at the location of our registered business address.

19. Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Omnismen regarding your use of the Services.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, products, or legal requirements. The updated version will be posted here with a revised "Last Updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
